These Terms of Service and Vehicle Sales Terms (the "Terms") apply to your use of this website and to every vehicle purchase and reservation deposit made through it, by phone, by email or at our lot. Please read them carefully. Section 13 contains a binding arbitration agreement and a class action waiver that affect your legal rights.
1. Who we are
Skyline Kei Trucks is a trade name used by two related companies, both located at 6100 Harvey Wilson Dr, Houston, TX 77020:
- Wideway Motors LLC, which sells the vehicles; and
- Skyline JDM Inc, which operates this website and collects payments, including reservation deposits, for vehicle sales.
In these Terms, "Seller", "we" and "us" mean Wideway Motors LLC and Skyline JDM Inc, together and each of them. A payment you make to Skyline JDM Inc for a vehicle or deposit counts as payment to Wideway Motors LLC. You can reach us at (713) 385-9798 or contact@skylinejdm.com. "You" means the person buying or reserving a vehicle or using this website.
2. Agreeing to these Terms
By placing an order, paying a reservation deposit, or checking the agreement box on a vehicle page, you agree to these Terms. You must be at least 18 years old and legally able to enter into a contract. If you are buying for a business, you confirm you are authorized to bind it.
3. VEHICLES ARE SOLD "AS IS" WITH NO WARRANTY
EVERY VEHICLE IS SOLD "AS IS" AND "WITH ALL FAULTS." SELLER MAKES NO WARRANTIES, EXPRESS OR IMPLIED, ABOUT ANY VEHICLE. TO THE FULLEST EXTENT PERMITTED BY LAW, SELLER EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTY OF MERCHANTABILITY AND THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. YOU ASSUME THE ENTIRE RISK AS TO THE QUALITY, CONDITION AND PERFORMANCE OF THE VEHICLE, AND THE ENTIRE COST OF ANY REPAIRS.
Our vehicles are used, imported vehicles that are typically 25 years old or older. They may have wear, rust, corrosion, leaks, prior repairs, mechanical, electrical or cosmetic defects, and parts that are hard to find in the United States. No employee or representative of Seller is authorized to make any warranty, promise or representation about a vehicle that is not in these Terms or in a written document signed by Seller.
For vehicles covered by the Federal Trade Commission's Used Car Rule, the vehicle's Buyers Guide is marked "AS IS – NO DEALER WARRANTY." The information you see on the window form for this vehicle is part of this contract. Information on the window form overrides any contrary provisions in the contract of sale.
4. Inspection before you buy
You are welcome to inspect and test drive any vehicle that is in Houston, by appointment, before you buy it. You may also have an independent mechanic inspect it at your own expense. If you choose to buy or reserve a vehicle without inspecting it, including any vehicle that is still in transit, you accept the vehicle in whatever condition it is in.
5. Listings, photos and odometer readings
Listings, photos, specifications and features are provided for identification only. They are based on information from Japanese export records, auction sheets and our own observations, may contain errors, and are not warranties. Colors and condition may look different in person.
Odometer readings are shown in kilometers, as displayed on the vehicle's odometer. The mileage of an imported vehicle cannot be independently verified. Seller does not warrant that the odometer reading reflects the vehicle's actual mileage. Treat the actual mileage as unknown.
6. Import status, title, registration and road use
Our vehicles are imported from Japan and are sold with their import paperwork. Unless Seller agrees otherwise in writing, Seller does not provide a state certificate of title or registration. You are solely responsible for titling, registering, inspecting, insuring and equipping the vehicle, and for any taxes and fees required by your state or local government.
Laws about kei trucks and other imported vehicles vary by state and change over time. Some states do not allow these vehicles on public roads, or limit where and how they may be driven. These vehicles were not manufactured to U.S. safety or emissions standards for new vehicles. Seller makes no representation that any vehicle can be titled, registered, inspected or driven on public roads in your state. Your inability to title, register or legally drive a vehicle is not grounds to cancel a purchase or to receive a refund of a deposit or the purchase price. You are responsible for operating the vehicle safely and in compliance with all laws.
7. Prices and payment
Prices are in U.S. dollars. Vehicles shown as "In Houston" are purchased by paying the full price at checkout. Payments are collected by Skyline JDM Inc. Seller may cancel any order affected by a pricing or listing error, or if a vehicle was already sold, and will refund any amount you paid for that order. A sale is final once Seller has received payment in full. Unless taxes are collected at checkout, you are responsible for any sales, use or motor vehicle taxes and fees that apply where you title or register the vehicle.
8. Reservation deposits for vehicles in transit
- Vehicles shown as "In Transit" are still on their way from Japan. You can reserve one with a $1,000 reservation deposit. Once Seller receives your deposit, the vehicle is marked Reserved and removed from sale.
- Your deposit is credited in full toward the vehicle's purchase price. The balance is due before pickup or shipping. If the balance is not paid within 14 days after we notify you that the vehicle is available, Seller may treat the reservation as cancelled by you.
- The deposit is non-refundable if you cancel or do not complete the purchase.
- If Seller cannot deliver the reserved vehicle for any reason (for example, it is lost, not released, or cannot be imported), Seller will refund your deposit in full. If the vehicle is materially damaged before it is picked up by you or released to your carrier, including during ocean shipping, at the port, in its shipping container or while at our Houston lot, Seller will tell you, and you may choose to complete the purchase or cancel and receive a full refund of everything you have paid for that vehicle. A refund is your only remedy in these situations.
- Estimated arrival dates are estimates only and are not guaranteed.
9. Pickup, shipping and risk of loss
Vehicles may be picked up at our Houston lot after payment in full. If you would like the vehicle shipped, we can help you arrange shipping within the mainland United States through independent carriers, at your expense. You pay the carrier directly. Seller is not a carrier and is not responsible for carrier delays or damage. Risk of loss passes to you when the vehicle is picked up by you or released to your carrier. Inspect the vehicle at delivery, note any damage on the carrier's bill of lading, and make any damage claim directly with the carrier. Vehicles that are not picked up within 14 days after payment in full may be charged reasonable storage fees.
10. All sales final
All vehicle sales are final. There are no returns, exchanges or refunds after payment in full, except where required by law. Seller does not accept trade-ins or trade offers.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SELLER'S TOTAL LIABILITY (THE COMBINED LIABILITY OF WIDEWAY MOTORS LLC AND SKYLINE JDM INC) ARISING OUT OF OR RELATING TO ANY VEHICLE, ORDER, DEPOSIT OR THIS WEBSITE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT VEHICLE OR DEPOSIT. SELLER WILL NOT BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, SPECIAL, INDIRECT OR PUNITIVE DAMAGES, INCLUDING LOSS OF USE, LOST PROFITS, TOWING, STORAGE, TRANSPORTATION OR RENTAL COSTS. The disclaimers and limits in these Terms also protect the owners, members, officers, directors, employees and agents of Wideway Motors LLC and Skyline JDM Inc.
12. Your responsibility for the vehicle
After the vehicle is delivered to you or your carrier, you are responsible for how it is used, maintained, insured and operated. You agree to indemnify and hold Seller and its owners, members, officers, directors, employees and agents harmless from claims, losses and expenses arising from your ownership, use or operation of the vehicle after delivery, except to the extent caused by Seller's own misconduct.
13. Binding arbitration and class action waiver
Please read this section carefully. It requires you and Seller to resolve disputes through individual arbitration instead of in court, and it waives the right to a jury trial and to participate in a class action.
- Informal resolution first. Before starting arbitration, the party with a dispute must send the other a written notice describing it. Notices to Seller go to Wideway Motors LLC and Skyline JDM Inc, 6100 Harvey Wilson Dr, Houston, TX 77020, or contact@skylinejdm.com. Both parties will try in good faith to resolve the dispute within 30 days.
- Arbitration. Any dispute, claim or controversy arising out of or relating to these Terms, any vehicle, order or deposit, or this website, including the scope or validity of this agreement to arbitrate, will be resolved by final and binding arbitration on an individual basis. This includes claims against Wideway Motors LLC, Skyline JDM Inc, or any of their owners, members, officers, directors, employees or agents. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (or its Commercial Arbitration Rules if you bought for a business), and decided by a single arbitrator. Hearings will take place in Harris County, Texas, or by phone or video if the arbitrator allows. Fees will be paid as provided by the AAA rules. Judgment on the award may be entered in any court with jurisdiction.
- Small claims. Either party may bring an individual claim in small claims court (a Texas justice court) instead of arbitration, if the claim qualifies.
- CLASS ACTION AND JURY TRIAL WAIVER. YOU AND SELLER EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO BRING OR PARTICIPATE IN ANY CLASS, COLLECTIVE OR REPRESENTATIVE ACTION. The arbitrator may award relief only to the individual party seeking it. If this class action waiver is found unenforceable as to any claim, that claim must be decided in court, not in arbitration, and the rest of this Section 13 still applies to all other claims.
- Opting out. You may opt out of this arbitration agreement by sending written notice to Seller at the address or email above within 30 days after your first order or deposit. Your notice must include your name, the vehicle and a clear statement that you opt out. Opting out does not affect any other part of these Terms.
- This arbitration agreement is governed by the Federal Arbitration Act and survives the completion of any sale.
14. Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, except that Section 13 is governed by the Federal Arbitration Act. For any matter not subject to arbitration, you and Seller agree to the exclusive jurisdiction of the state and federal courts located in Harris County, Texas.
15. Using this website
We work to keep listings accurate and up to date, but vehicles can sell or change status quickly. Website content may contain errors and may change without notice. All content on this website belongs to Seller or its licensors and may not be copied for commercial use without permission.
16. General
These Terms, together with the vehicle's Buyers Guide (if any), any bill of sale signed by both parties, and our Refund and Shipping policies, are the entire agreement between you and Seller about your purchase or deposit. If any part of these Terms is found unenforceable, the rest remains in effect. Seller may update these Terms from time to time. The version in effect when you place your order or deposit applies to that transaction.
